GENERAL TERMS AND CONDITIONS OF SALE
\nERIM SRL invites users to read these General Conditions of Sale (“CGV”) that regulate the purchase of products and the management of orders placed on the site shoponline.erim.it. By making any purchase, the customer fully accepts these General Conditions of Sale.<\/p>\n
1. Conclusion of the contract<\/p>\n
Every order placed on shoponline.erim.it implies the conclusion of a purchase agreement between the buyer and ERIM SRL. By clicking on the “Buy now” button, the customer makes a binding order relating to the items contained in the virtual shopping cart. As a consequence, ERIM SRL will send an e-mail confirming the order within 1 working day to the address indicated by the customer during registration. The purchase contract is concluded between ERIM SRL and the customer when the latter receives the order confirmation. If the customer does not receive any confirmation of the order within the period indicated in this art. 1, the related order must be considered rejected by ERIM SRL and, therefore, devoid of effect.<\/p>\n
2. Availability of Products and payments<\/p>\n
Where the Products covered by the order are not available, ERIM SRL will promptly notify the customer by e-mail and \/ or other contact method provided by the buyer at the time of registration. In this case, there will be no obligation to deliver the Products for ERIM SRL. In any case, if the Products ordered are not available, ERIM SRL will provide without any delay to the reimbursement, in favor of the customer, of any sum already paid.<\/p>\n
The customer is required to pay the price published on the order summary page and in the order confirmation email. The indicated price is final and inclusive of VAT and transport costs. The purchase contract is resolutively conditional upon the non-payment of the Total Due Amount. In the event that such payment is not made, the contract will therefore be terminated by right.<\/p>\n
ERIM SRL accepts payments by bank transfer or PayPal.<\/p>\n
-Payment by bank transfer: the bank details for the bank transfer will be indicated in the order confirmation email. The payment of the Products by bank transfer must take place no later than 7 calendar days from the date of the order. Once this deadline has expired, the contract can be considered terminated by right, with the consequent reimbursement of the Total Amount possibly paid late. In the case of payment by bank transfer, the Products will be shipped only after receipt by ERIM SRL of the bank transfer. Consequently, the delivery terms of the Products will start from that date. To facilitate the connection between the payment received by bank transfer and the order placed, the customer is asked to indicate the order number in the reason for the bank transfer.<\/p>\n
-Payment via PayPal: If the user chooses as a means of payment PayPal, he will be redirected to the website www.paypal.it where he will pay for the Products according to the procedure provided and regulated by PayPal and the terms and conditions of contract agreed by the user with PayPal. The Total Due amount will be charged by PayPal to the user together with the conclusion of the online contract. In case of termination of the purchase contract and in any other case of reimbursement, for whatever reason, the refund amount will be credited to the user’s PayPal account. The timing of re-credit on the payment instrument linked to this account depends exclusively on PayPal and the banking system.<\/p>\n
3. Shipping of Products<\/p>\n
Packages are generally sent within 1 working day of receipt of payment and are shipped via “TNT” express courier, with tracking and delivery without signature. At the time of shipment will be sent to the user an e-mail confirming the delivery to the carrier which will also contain the link containing the tracking number through which the user can check the status of the shipment.<\/p>\n
Transport costs can be viewed in the “Delivery and shipping” section. We advise you to group your items in one order. We can not group two separate orders separately, so shipping costs will be charged for each one.<\/p>\n
The delivery is understood to have occurred with the delivery of the Products to the courier. From the moment of delivery of the Products to the same, ERIM SRL is released from any risk and liability for events of any nature that may occur during transport.<\/p>\n
The Purchaser must verify, in his own interest, the quantity and conditions of the Products before collection and, in case of discrepancies, make the appropriate written reservations to the express courier. ERIM SRL will reject\u00a0any dispute regarding the number and status of packages if the Buyer has not expressed such disputes in writing to the courier at the time of collection of the Products and has not communicated it to ERIM SRL within 8 days from receipt of the Products.To view the countries where ERIM SRL sends the products see the section “Delivery and shipping”. If the delivery time is expressed in working days, this means all those included between Monday and Friday inclusive, with the express exclusion of any holidays.4. Right of withdrawal The customer has the right to withdraw from the purchase contract, without giving any reasons, within 14 days from the day he received the product. If the customer has appointed a person of his trust to withdraw, the right of withdrawal starts from the day of delivery of the Product to the designated person, different from the courier. To exercise the right of withdrawal it is necessary to inform ERIM SRL of the decision to withdraw from the contract via e-mail (info@erim.it). For this purpose it is possible, but not mandatory, to use the standard withdrawal form that can be downloaded here. ERIM will transmit without delay confirmation of receipt of withdrawal on a durable medium (email). To comply with the withdrawal deadline, it is sufficient that the customer sends the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.5 . Effects of withdrawal If the user withdraws from the contract, ERIM SRL will refund the Total Amount Due paid by the user for the Product, including delivery costs, without undue delay and in any case no later than 14 days from the day on which ERIM SRL has been informed of the user’s decision to withdraw from the contract. These refunds will be made using the same means of payment used by the user for the initial transaction, unless the user has expressly agreed otherwise; in any case, the user will not incur any costs as a consequence of such reimbursement. The refund can be suspended until the receipt by ERIM SRL of the Products object of the return, or until the demonstration by the consumer to have sent back the goods, if previous. The customer is obliged to return or deliver the products to ERIM SRL without undue delay and in any case within 14 days from the day on which he has communicated his withdrawal from the present contract. Products must be returned: – properly packaged in their original packaging (not damaged, damaged or dirty) and equipped with any accessories, instructions for use and documentation, – provided with the transport document (present in the original packaging), in order to allow ERIM SRL to identify the customer (order number, name, surname and address) – without manifest signs of use, if not those compatible with the performance of a normal p item of the article (must not bear a trace of prolonged use or exceeding the time necessary for a test and must not be in a state that does not allow the resale). The direct costs of returning the Products will be charged to the customer. The customer is liable for any decrease in the value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the products themselves.In the event that the withdrawal has not been exercised in accordance with the provisions of applicable law, it will not result in termination of the contract and, consequently, will not give right to any reimbursement. ERIM SRL will inform the user, by e-mail, within 5 working days from receipt of the Product, rejecting the request for withdrawal. The Product will remain at ERIM SRL available to the user for collection, which must be at the expense and under the responsibility of the user.6. General product warnings The Erim products are installation products, intended for professional use only. They must be installed by qualified personnel, according to the intended destination and in compliance with applicable standards. Weights, dimensions and technical characteristics if indicated are for information purposes and are therefore not binding.7. Returns under warranty Any request for warranty returns due to alleged defects or non-conformity of the product must be previously authorized by ERIM SRL. If the non-compliance of ERIM SRL is ascertained, the returned products will be replaced with equal products or equivalent products. In case of authorized return, the goods must be returned carriage paid at the warehouse of the supplying company: ERIM SRL, via Bovisasca 24 – 20026 Novate Milanese (MI) .8. Applicable law These GCS and purchase and sale contracts are governed by Italian law (and in particular by the Code\u00a0and of the Consumption – that to the artt. from 46 to 67 governs distance contracts – and Legislative Decree 70 of 09\/04\/2003 on electronic commerce) and in light of this must be interpreted.
